Professional Profile

An accomplished advocate with a strong track record in inquest and public law, Caroline practises predominantly in civil litigation. In an average year, she appears for a range of public sector clients at around 50 inquests, dealing with everything from straightforward investigations to more complex Article 2 cases with a jury.

As a member of the Attorney-General’s Regional Panel of counsel, she is instructed by government departments to defend civil claims and she represents both claimants and defendants in small claims, fast track and multi-track trials, as well as appearing in the county and high courts for applications, costs and interlocutory hearings. Public law is an expanding area of her practice, with a particular focus on bringing and defending judicial review claims.

Caroline has a busy paperwork practice and is regularly briefed to draft pleadings and to advise on liability, causation and quantum.

Before coming to the Bar, Caroline worked in public sector PR and marketing for local, regional and national government agencies, where she was frequently involved in managing the reputational impact of legal proceedings, including employment tribunals, court of protection work and legislative change.

Areas of Work

Civil Litigation

Caroline is routinely instructed for small claims, fast track and multi-track trials in personal injury, credit hire, contract disputes and road traffic matters. She appears for claimants and defendants in all proceedings from interim applications, CCMCs, allocation, disposals and appeals.

On the paperwork front, Caroline has a busy practice drafting Particulars of Claim, defence and counter-claims, witness statements, Part 18 and Part 35 questions and replies, application notices and proposed directions. She advises a diverse range of clients on all aspects of civil litigation, such as quantum, liability, causation and merits in RTA, employers’, occupiers’ and public liability cases.

As a member of the Attorney-General’s Regional Panel of counsel, Caroline regularly appears for the government in claims brought by litigants in person, often serving inmates, and so is called upon to convey complicated legal proceedings in straightforward terms.

Having undertaken specialist training in expert and vulnerable witness handling, Caroline is comfortable cross-examining anyone from consultant psychiatrists or pathologists to children at risk.

 

Employment

Caroline has experience of advising on unfair dismissal, discrimination, misconduct proceedings and redundancy, and has appeared at the Employment Tribunal. In the context of her government work, she regularly advises on Equality Act and human rights claims.

Inquests

Caroline has extensive experience of appearing at inquests both with and without a jury and routinely deals with arguments relating to Article 2 and scope, causation, resumption, and Regulation 28. She represents police forces, local authorities, prisons and government departments so is well-versed in matters such as PII applications, anonymity and judicial review. She is familiar with the independent investigations that often accompany police and prison deaths and has provided training and guidance to agencies on preparing for challenging and high-profile inquiries. Caroline often handles the civil litigation that arises from inquests and can advise on settlement options.

More recently, Caroline has acted for the families of the deceased in cases involving suicide and mental health concerns, where there was no legal funding available for representation.

Caroline has been appointed as an Assistant Coroner for Cambridgeshire& Peterborough.

Police Law

Caroline advises on and appears in civil actions against the police, predominantly acting for the police in claims both with and without a jury. She has experience of advising on misconduct matters and has been instructed on a number of high-profile health and safety and firearms cases. On a day-to-day level, her advice and representation is sought on claims involving matters as diverse as deployment of police dogs, property searches, legal privilege and disclosure, data protection and subject access requests, and seizure of goods and vehicles.

She has experience of delivering training to police forces on preparing for and attending at court and inquests, and regularly hosts witness conferences to assist officers and police staff who are called to give evidence.

In order to provide continuity to her police clients, she has conduct of a number of civil and human rights claims arising from inquests, also attending joint settlement meetings to negotiate settlements.

Public Law

Caroline’s practice has developed to include a greater focus on public law. She regularly advises in cases where judicial review proceedings are contemplated and has an excellent track record in defending such actions brought against a range of public bodies. She has previously been a member of the Home Office Regional Panel for immigration appeals and now deals with multiple claims on behalf of government departments involving human rights, immigration and the Equality Act.

Inquests

  • Inquest into the death of PW- representing a police force in a case where a child was found to have died following an assault by a family member, and subsequently advising on a civil claim.
  • Inquest into the death of RM- representing a local authority in a case where a vulnerable adult with learning difficulties living in supported accommodation died, where there was a finding of neglect
  • Inquest into the death of NW- one of a series of inquests arising out of domestic homicides, dealing with issues of coercion and control and serial domestic abuse.
  • Inquest into the death of MH- representing a police force in an unlawful killing case, where the assailant should have been recalled to prison on licence.
  • Inquest into the death of SD- appearing for the Ministry of Justice in one of a number of prison custody deaths involving criticisms of the prison healthcare provision for elderly inmates.
  • Inquest into the death of KC- instructed by a police force in a case of a teen suicide following allegations of sexual abuse

Police

  • JB v CCGMP– successfully defending the police in a civil claim alleging unlawful force and detention
  • AB v CCGMP– one of a number of claims in which Caroline secured the strike out of litigation which was held to be without merit and averting significant costs
  • HSE v E, F and CCGMP– representing the Chief Constable in a health and safety prosecution arising out of a death during firearms training.

Public Law

  • WB v Home Office and others– advising in connection with a JR claim for modern slavery
  • HS v SSHD– appearing for the Home Office to resist a claim for JR in an immigration appeal case against a litigant in person
  • RG v MOJ– appearing in multiple hearings to seek strike out of various JR claims in relation to benefits claims which were without merit.
