- Home Loan/Double Trust IHT avoidance schemes of the Noughties – Home Loan/Double Trust IHT avoidance schemes were sold in the Noughties. Now, twenty years later, they are being tested before the Tax Tribunals. Were they effective? Do clients even know they have entered into them? Should they be unravelled? What are the tax consequences.
- Testamentary Capacity: The beginning of the end for Banks v Goodfellow? Will Baker & Spiers v Hewston [2023] EWHC 1145 (Ch) mark the start of a process to replace the test for testamentary capacity in Banks v Goodfellow with the statutory test for capacity laid down in the Mental Capacity Act 2005.
