John Benson KC and Alexander Jones from Atlantic Chambers have secured a multi-million-pound lump sum settlement for a 36-year-old (who was aged 34 at the time of accident) who was involved in a serious RTA which resulted in severe and life changing injuries.

The Claimant underwent multiple operations over a short period following the accident in order to save his lower left limb, but his injuries were so severe that a trans-tibial amputation was required.

The matter proceeded to a joint settlement meeting in July 2024 and following a long day of negotiation, a settlement was achieved on behalf of the client which included a multi-million-pound lump sum settlement to reflect his ongoing care, future accommodation, loss of earnings, lifetime prosthetics and provides sufficient provision to meet all of his future needs.

The JSM was complicated by the pending review to the PI Discount Rate and the likely delay until any trial. Further, the Claimant’s pre-index occupation (self-employed restaurateur in a family ran business) and cultural expectations added significantly to the complexity of the Claimant’s losses which were agreed on an Ogden basis.
